Terms of Service

These terms are an agreement between you and TV-Top Games ("TV-Top", "we", "us"), a company registered in Wyoming, United States. They cover your use of our website at tvtop.games, the game at play.tvtop.games, our apps for phones, tablets, computers and TVs, TV-Top devices, and anything else we offer that links to these terms (together, the "Services").

By using the Services, you agree to these terms. If you don't agree, please don't use the Services.

Please read the Disputes section. It says that most disputes will be settled by individual arbitration, not in court or by class action.

Who can use TV-Top

You must be at least 13 years old to create an account. If you're under 18, or the age of majority where you live, a parent or guardian must agree to these terms for you and supervise your use. Younger children are welcome to play at the family table on an adult's game, with that adult present. The adult is responsible for how the child uses the Services.

Accounts

You can play as a guest with just a name, or create an account with an email address and password, or a sign-in from Apple, Google or Facebook (or a phone number, in the app). Your account is for you alone.

  • Keep the details you give us accurate.
  • Keep your password and sign-in safe. You're responsible for what happens on your account.
  • Tell us right away at contact@tvtop.games if you think someone else is using it.

A guest account lives only on the device you used. If you sign out or lose the device before linking the guest account to a sign-in, we can't recover it.

Buying games

When you buy a game, you get a personal, non-transferable licence to play it through the Services for as long as you keep your account. Buying a game doesn't give you ownership of the game or its software.

  • One purchase covers the table. Only the host needs to own a game. Other players can join that host's game free.
  • Taking a game out of the shop doesn't take it away from people who already bought it.
  • We update games to fix bugs, balance play and add features. A game may look or play somewhat differently over time.
  • Purchases are tied to the store you bought from. Games bought on tvtop.games belong to the account that bought them. Games bought in the App Store or Google Play belong to that Apple or Google account, and can be restored with Restore Purchases in the app. Our account deletion page explains what happens to each kind of purchase if you delete your account.
  • Early access and beta games are unfinished. They may change a lot, or occasionally be withdrawn.

Supporter subscription

Supporter is a monthly subscription. It gives you the games and perks described on the Supporter page for as long as it's active.

  • Renewal. Supporter renews automatically each month, and you're charged the price shown when you subscribed, until you cancel. You authorize us, or the App Store or Google Play, to charge your payment method each month.
  • Free trial. If we offer a free trial, you get one per account. If you've had Supporter before, on any store, you won't get another. Checkout asks for a payment method. You're charged when the trial ends unless you cancel before then.
  • Cancelling. You can cancel any time. If you subscribed on tvtop.games, go to your account page. If you subscribed in the App Store or Google Play, cancel in that store's subscription settings. Deleting your TV-Top account doesn't cancel an App Store subscription, so cancel it with Apple first.
  • After you cancel, Supporter keeps working until the end of the trial or the month you've paid for, then stops. Games you bought outright are unaffected.
  • Price changes. If we change the Supporter price, we'll tell you in advance, and the new price applies from your next renewal. If you don't want to pay the new price, cancel before then.
  • Perks can change. We may add to or change the games and perks included with Supporter.

Prices, payment and refunds

Prices are in US dollars unless the store shows otherwise, and include or add any sales tax required where you live. Payments on tvtop.games are processed by Stripe. Payments in our apps are processed by Apple or Google under their terms. We never see or store your full card details.

We may change prices at any time, but a price change never affects something you've already paid for. If we make an obvious pricing mistake, we may cancel the order and refund you.

Refunds. All purchases and subscription payments are final and non-refundable, except where the law says otherwise. Refunds for App Store and Google Play purchases are handled by Apple and Google under their own policies. If something has gone wrong with a purchase, email us at contact@tvtop.games and we'll look at it.

Playing fair

When you use TV-Top, don't:

  • cheat, exploit bugs, or use bots, scripts or automated tools to play, create accounts or collect information from the Services,
  • harass, threaten or abuse other players or our team,
  • pretend to be someone else,
  • try to get into accounts, games or systems you're not allowed into, or get around limits on access, purchases or features,
  • interfere with the Services, overload them, or upload malware,
  • copy, sell, rent or redistribute our games, or decompile or reverse engineer our software, except where the law allows,
  • use TV-Top commercially, for example by charging people to play it or running it as entertainment in a business, without our written permission,
  • break the law or anyone else's rights.

If you find a bug or a security problem, please tell us instead of using it. We appreciate it.

Names and what you share

Your display name, Supporter badge and anything else you share at the table are seen by the other players, and by anyone with the game's link. Keep them free of anything offensive, hateful, sexually explicit, or that infringes someone else's rights. We can change or remove a name or badge that breaks these rules.

You keep ownership of what you share. You give us a licence to store and show it as part of running the Services.

If you send us ideas or feedback, we're free to use them without owing you anything.

Our games and content

The Services and everything in them belong to TV-Top or the people we license them from. That includes the games, artwork, music, software and the TV-Top name and logo. Apart from the licence to play described in these terms, you don't get any rights in them.

Our games are original works. They aren't affiliated with or endorsed by the publishers of any other board game. Chromecast, Google TV, Roku, App Store, Google Play and other product names belong to their owners.

Other companies' services

TV-Top works with other companies' products: TVs and casting devices, app stores, sign-in providers and payment processors. Their own terms apply when you use them, and we're not responsible for them. Casting depends on your network and devices, which we don't control.

Our apps are also covered by our End User License Agreement.

Privacy

Our Privacy Policy explains how we handle your information. Our Cookie Policy explains the cookies on our website.

Ending your use of TV-Top

You can stop using TV-Top whenever you like, and delete your account at any time.

We may suspend or close an account that breaks these terms or puts other players or the Services at risk. Where it's reasonable, we'll tell you first and give you a chance to fix the problem. If we close your account without a good reason, we'll refund any unused part of a subscription you paid us directly.

The sections on licences you've given us, refunds, disclaimers, limitation of liability, indemnity and disputes still apply after your account ends.

Changes

To the Services. We're always working on TV-Top, so features, games and supported devices will change. We may also stop offering part or all of the Services. If we ever shut TV-Top down, we'll give at least 30 days' notice, and refund any unused part of a subscription you paid us directly.

To these terms. We may update these terms. We'll change the date at the top. If the change is significant, we'll tell you by email or in the app before it takes effect. If you keep using the Services after that, you agree to the new terms.

Disclaimers

We work hard to make TV-Top fun and reliable, but the Services are provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise the Services will be uninterrupted, error-free or work with every TV, device or network.

Some places don't allow these exclusions, so some of them may not apply to you.

Limitation of liability

To the fullest extent the law allows, TV-Top and its owners, employees and agents won't be liable for any indirect, incidental, special, consequential or punitive damages. That includes lost profits, data or goodwill. It applies even if we were told such damages were possible.

Our total liability for any claim about the Services is limited to the amount you paid us in the six months before the claim arose.

Nothing in these terms limits liability that can't be limited by law, such as for fraud, or for death or personal injury caused by negligence.

Indemnity

If someone brings a claim against us because of your misuse of the Services, or because you broke these terms or someone's rights, you'll cover our reasonable losses and costs from that claim, including legal fees. We'll tell you about the claim, and we may take charge of the defense.

Disputes

Talk to us first. Most problems can be solved quickly by email. Before starting any formal claim, you and we each agree to try to resolve it informally for at least 30 days. Either side starts this by sending written notice. Send yours to contact@tvtop.games.

Arbitration. If we can't resolve it informally, the dispute will be settled by binding individual arbitration, not in court. You and we both give up the right to a jury trial. The arbitration will be run by the American Arbitration Association under its Consumer Arbitration Rules, which limit the fees you pay. It can take place by video, by phone, in writing, or in person in Cleveland, Oklahoma.

No class actions. Disputes are resolved individually. Neither you nor we can bring or join a class, collective or representative action.

Exceptions. Either side may instead:

  • bring an individual claim in small claims court,
  • go to court to protect intellectual property, or to stop unauthorized use of the Services.

If a court has to decide a dispute, it will be the state or federal courts for Cleveland, Oklahoma. You and we both agree to those courts' jurisdiction.

Time limit. Any claim must be brought within one year after it arises, unless the law requires a longer period.

Governing law. These terms are governed by the laws of the State of Oklahoma and the Federal Arbitration Act, without regard to conflict-of-law rules.

General terms

  • These terms, together with the policies they link to, are the whole agreement between you and us about the Services.
  • If part of these terms can't be enforced, the rest still applies.
  • If we don't enforce part of these terms right away, we can still enforce it later.
  • You may not transfer your rights under these terms. We may transfer ours, for example if TV-Top is sold.
  • We're not responsible for delays or failures caused by things outside our reasonable control.
  • You agree that we can send you notices, agreements and records electronically.
