End User License Agreement

This End User License Agreement ("EULA") is between you and TV-Top Games ("TV-Top", "we", "us"), a company registered in Wyoming, United States. It covers the TV-Top Games apps for phones, tablets, computers and TVs, the software on TV-Top devices, and their updates (together, the "App"). That includes the apps you get from the App Store, Google Play or a TV maker's store.

By installing or using the App, you agree to this EULA and to our Terms of Service, which also apply. If they conflict about your licence to the App, this EULA wins. If you don't agree, don't install or use the App.

The licence

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control. It's for your own non-commercial use, and must follow these terms and the rules of the store you got it from. Where a store allows Family Sharing, the App may also be used by members of your family group.

The App is licensed to you, not sold. We and our licensors keep all rights not expressly given to you here.

What you can't do

Except where the law allows or we've given written permission, you may not:

  • copy, modify or make derivative works of the App,
  • decompile, reverse engineer, disassemble or try to get the App's source code,
  • rent, lease, lend, sell, redistribute or sublicense the App,
  • remove copyright, trademark or other notices,
  • use the App commercially, for example by charging people to play it,
  • use the App in a way that breaks the law or our Terms of Service.

Updates and requirements

We may release updates that fix bugs, change features or add games. Some updates install automatically. To keep playing online, you may need the latest version. The App needs an internet connection, and casting needs a compatible TV or casting device on the same network.

Purchases and subscriptions

You can buy games and subscribe to Supporter in the App through your app store. These purchases are covered by the Buying games, Supporter subscription and Prices, payment and refunds sections of our Terms of Service, and by the store's own terms.

Your data

Our Privacy Policy explains what the App collects and how we use it. That includes account details, games and stats, purchases, crash reports and usage analytics.

Ending this licence

This licence lasts until you or we end it. You can end it by deleting the App. It ends automatically if you break this EULA. When it ends, you must stop using the App and delete it from your devices.

Warranty and liability

The App is provided "as is". The Disclaimers, Limitation of liability and Disputes sections of our Terms of Service apply to the App. Nothing in this EULA limits any rights you have under consumer protection law that can't be waived.

App Store terms

These terms apply if you got the App from Apple's App Store:

  • This EULA is between you and TV-Top, not Apple. TV-Top, not Apple, is solely responsible for the App and its content.
  • Scope. Your licence is limited to using the App on Apple-branded products you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions allow. Other accounts in your purchase group can use it through Family Sharing or volume purchasing.
  • Support. TV-Top is solely responsible for maintenance and support of the App. Apple has no obligation to provide any. Contact us using the details below.
  • Warranty. If the App fails to meet any warranty that applies, you can notify Apple, and Apple will refund the App's purchase price to you, if you paid one. To the maximum extent the law allows, Apple has no other warranty obligation for the App. TV-Top is responsible for any other claims, losses, liabilities, damages, costs or expenses from a failure to meet a warranty, to the extent this EULA doesn't disclaim them.
  • Product claims. TV-Top, not Apple, is responsible for any claims by you or anyone else about the App or your having or using it. That includes:
    • product liability claims,
    • claims that the App fails to meet a legal or regulatory requirement,
    • claims under consumer protection, privacy or similar laws.
  • Intellectual property. If someone claims that the App, or your having or using it, infringes their intellectual property rights, TV-Top, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
  • Legal compliance. You confirm that you're not located in a country subject to a US government embargo, or designated by the US government as a "terrorist supporting" country. You also confirm that you're not on any US government list of prohibited or restricted parties.
  • Third-party terms. You must follow any third-party terms that apply when you use the App, such as your wireless data agreement.
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this EULA. Once you accept it, Apple has the right, and is deemed to have accepted the right, to enforce it against you as a third-party beneficiary.

Google Play and other stores

If you got the App from Google Play or another app store, that store isn't a party to this EULA and isn't responsible for the App or its support. The store's own terms also apply to your download and any purchases. If those terms conflict with this EULA, the store's terms win, but only to the extent of the conflict.

Governing law

This EULA is governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Disputes are handled as described in the Disputes section of our Terms of Service.
